Privacy Policy

Welcome to Price Backers! This privacy policy applies to our app. If “we” or “us” is used in this privacy policy, we refer to us the “data controller”. This policy sets out the basis on which any Personal Data we collect from corporate account holders or individual users will be processed by us when you use our application and services (hereinafter our “Services”).

Account-holders and individual users or owners of Personal Data processed by us (each, “you”) should read the following carefully to understand our views and practices regarding your Personal Data and how we will handle it.

In principle, we will only use your Personal Data in accordance with Israel`s Protection of Privacy Law, 5741-1981 (“PPL”), the General Data Protection Regulation (“GDPR”), the California Online Privacy Protection Act (“CalOPPA”), the California Consumer Privacy Act of 2018 (“CCPA”) and of course only as described in this privacy policy.

What is Personal Data?

Personal data is any information relating to personal or material circumstances that relates to an identified or identifiable individual. This includes, for example, your name, date of birth, e-mail address, postal address, or telephone number as well as online identifiers such as your IP address. In contrast, information of a general nature that cannot be used to determine your identity is not Personal Data.

What is processing?

Processing means any operation or set of operations that is performed upon Personal Data, whether by automatic means. The term is broad and covers virtually any handling of Personal Data.

Pseudonymous data processing

The processing of pseudonymous data, i.e., information that cannot be directly attributed to you as a person, is not legally necessary for the conclusion of a contract with us, but serves the purposes described below:

a) Analysis of the services
We use analysis tools to analyze the Services. In doing so, we can process usage data of the services with the help of cookies and thus obtain knowledge about the use of our services. You have the right to object at any time with effect for the future to processing based on our legitimate interest.

b) Advertising and personalization
If your pseudonymous data is processed for advertising purposes, you have the right to object to this processing at any time with effect for the future.

Acknowledgements

By providing any Personal Data to us, you consent to the collection, use, disclosure, and transfer of such Personal Data in the manner and for the purposes set out below.

You agree that, if you have provided us with Personal Data relating to a third party
you have in place all necessary appropriate consents and notices to enable lawful transfer of such Personal Data to us. You agree to indemnify us in relation to all and any liabilities, penalties, fines, awards, or costs arising from your non-compliance with this requirement.

Relevant legal basis

In the following, we inform you about the legal basis on basis of which we process Personal Data. If more specific legal bases apply in individual cases, we will inform you of these in the privacy policy.

  • Consent – The data subject has given his/her consent to the processing of Personal Data relating to him/her for a specific purpose or purposes.
  • Performance of a contract and pre-contractual inquiries – Processing is necessary for the performance of a contractual relationship to which the data subject is a party or for the performance of pre-contractual measures carried out at the data subject’s request.
  • Legitimate interests – Processing is necessary for the purposes of the legitimate interests of the controller or a third party unless such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of Personal Data.

Your Rights

a) PPL Rights
If you are a Citizen or resident of Israel, you have the following rights:

  • to request for information;
  • to inspect information;
  • to amendment of information;
  • to lodge a complaint;
  • to opt out from marketing;
  • to be informed on how your data is processed; and
  • to have information relating to marketing deleted.

 

b) GDPR Rights
If you are a European Citizen or resident, you have the following rights:

  • to confirmation as to whether data relating to them is being processed;
  • to information about the data processing, to further information about the data processing, and to copies of the data;
  • to correction or completion of incorrect or incomplete data;
  • to immediate erasure of the data concerning them;
  • to receive the data concerning them and provided by them and to transfer this data to other providers/controllers; and
  • to lodge a complaint with the supervisory authority if they are of the opinion that the data concerning them is being processed by the provider in breach of data protection provisions.

 

c) California Rights

If you are a California resident, you have the following rights:

  • You may submit a verifiable request for information regarding the: (1) categories of Personal Data we collect, use, or share; (2) purposes for which categories of Personal data are collected or used by us; (3) categories of sources from which we collect Personal data; and (4) specific pieces of Personal data we have collected about you;
  • We will not discriminate against you if you exercise your privacy rights; 
  • You may submit a verifiable request to close your account and we will delete Personal data about you that we have collected;
  • Request that a business that sells a consumer’s Personal Data, not sell the consumer’s Personal Data;
  • To be informed about the Processing of Personal Data by means of a notice;
  • To access our website anonymously;
  • To honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track browser mechanism is in place. (Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked).

 

The above rights may be limited in some circumstances, for example, if fulfilling your request would reveal Personal Data about another person, if you ask us to delete information which we are required to have by law, or if we have compelling legitimate interests to keep it. We will let you know if that is the case and will then only use your information for these purposes. You may also be unable to continue using our services if you want us to stop processing your Personal Data.
If you wish to exercise any of the rights listed above, you can contact us. For your protection and the protection of all our users, we may need to request certain information from you to help us confirm your identity before we can respond to the above requests. Please direct all requests for information, requests for information or objections to data processing to us.
If you feel that we have not resolved your concern, you have the right to make a complaint at any time.

Information we may collect

We may collect and process the following data which may contain Personal Data:

  • information that you provide to us, including information provided at the time of registering to use our Services, subscribing to any services provided by us, posting material, reporting a problem, installing and implementing our services in your store, or requesting further Services;
  • information, data, documents or images that you upload when you use our Services.
  • details of transactions you carry out through our Services;
  • details of your visits to our Services, resources that you access and actions you are working on through the Services;
  • if you contact us, a record of that correspondence.

 

a) Usage data

We collect data on every access to our services on the basis of our legitimate interests, we collect data on every access to the server on which this service is located. The access data includes the name of the web site accessed, file, date and time of access, volume of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.

Usage data is stored for security reasons (e.g., for the clarification of abuse or fraud) for a maximum of seven days and then deleted. Data whose further storage is required for evidentiary purposes is exempt from deletion until the respective incident has been finally clarified.

b) IP Addresses
We may also collect and process information about your device, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our business partners. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

c) Location Data
If you have given us your consent and where applicable data protection law permits it, we may also use and store information about your location in de-identified form. We use this data to provide features of our Service and to improve and customize our Service. To find out if you have enabled the use of your location data or to deactivate it, please go to the settings of your device.

d) Cookies

  • Tracking and Analytical cookies

We use Tracking and Analytical cookies to monitor your activity on our Service. We and our third-party provider may also combine information obtained from these cookies with Personal Data available from other sources. The legal basis for the use of Tracking and Analytical cookies (and the associated collection and processing of Personal Data) is your consent.

  • Technically necessary cookies

We use Technically necessary cookies which are required for our services to function properly; they enable you to navigate our services efficiently and use its functional features. The legal basis for the collection and processing of Personal Data in the context of the use of technically necessary cookies is the fulfillment of our contractual obligations or the protection of our legitimate interests, which consist in particular in providing you with our services with its essential functions.

e) Contract fulfillment and data management in the context of service provision

We process various data within the framework of the provision of our services and for the initiation and processing of the existing contractual relationship between you and us. If you have commissioned us to provide a service, we process your data (if provided: Name, contact details (email address and telephone number), address, bank details, copy of ID card, proof of residency/address) and all information that is necessary for the context of fulfilling the services, exclusively for the purpose of processing and handling the contractual relationship. This includes in particular our support, correspondence with you, invoicing, and fulfillment of our accounting and tax obligations. Accordingly, the data is processed on the basis of our contractual services as well as to fulfill our legal obligations.

f) Administration, financial accounting, office organization, contact management.

We process data in the context of administrative tasks as well as the organization of our operations, financial accounting and compliance with legal obligations, such as archiving. In this regard, we process the same data that we process in the course of providing our contractual services. The processing bases are our legitimate interests and our legal obligations. The purpose and our interest in the processing lies in the administration, financial accounting, office organization, archiving of data, i.e., tasks that serve the maintenance of our business activities, performance of our tasks and provision of our services.

g) Technical services

We process the data of our customers in order to enable them to select, purchase or commission the selected services. The required information is identified as such in the context of the order, purchase or comparable contract conclusion and includes the information required for the provision of services and billing as well as contact information. The legal bases are contractual performance and pre-contractual inquiries, legal obligation, and our legitimate interests.

h) Contacting us

If you contact us, we process the following data from you for the purpose of processing and handling your enquiry: Name, contact details -if provided by you- and your message. The legal basis of the data processing is our obligation to fulfil the contract and/or to fulfil our pre-contractual obligations and/or our legitimate interest in processing your inquiry.

i) System notifications, Marketing correspondence and Newsletter

By using our services, you are giving your consent to receiving system notifications, Marketing correspondence and Newsletters per email. Those typically include administrative information about your account warnings and alerts as well as other relevant notifications relating to your account or profile activity on the services. The system notifications are designed to serve as reminders or helpful tips enhancing your experience with our services. You cannot opt-out of receiving system notifications however, you can opt-out form marketing correspondence and our newsletter at any time. The legal basis for notifications is contractual performance and to provide you with our services and your consent and our legitimate interests for marketing correspondences and newsletters.

j) Payment systems

For the purpose of paying for our services you may provide, the respective payment-relevant data to our payment service provider. Certain Personal Data are required for the fulfillment of the contract. Without this data, we will, unfortunately, have to refuse to conclude the contract, as we will then not be able to carry it out. The data will be transmitted accordingly to our payment service provider for payment processing. The payment systems we use operate SSL encryption to protect the transmission of your data. Your Payment data is processed and encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) and sent to payment service provider. Our payment service provider adheres to the standards set by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, and American Express. PCI-DSS requirements help ensure the secure handling of credit card information by our website. The legal bases are contractual performance and our legal obligation.

Where we store your data

The Personal Data that we collect may be transferred to, and stored at, Amazon Web Services, Inc. using the Amazon Relational Database Service (RDS). It may be processed by staff operating who work for us or for Amazon. Such staff maybe engaged in, among other things, the fulfilment of your services, the processing of your payment details and the provision of support services. By submitting any Personal Data to us, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our Services; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

Uses made of the information

We use information held, including Personal Data, in the following manner:

  • to ensure that content from our Services is presented in the most effective manner for you and for your device;
    to provide you with information, products, or services that you request from us, and to otherwise carry out our obligations arising from any contracts entered into between you and us;
  • to provide you with information, products or services which we feel may interest you, where you have consented to be contacted for such purposes;
  • to allow you to participate in interactive features of our service when you choose to do so;

We may disclose your Personal Data to third parties:

  • for the purposes of providing products or services that you request from us, fulfilling our obligations arising from any contracts entered into between you and us, processing payments in connection therewith or otherwise in connection with your use of our Services;
  • where a third party claims that any content posted or uploaded by you to our Services constitutes a violation of their rights under Singapore law, in which case we may disclose your identity to that third party;
  • in the event that we sell or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets; or
  • if we or substantially all of our shares or assets are acquired by a third party, in which case Personal Data held by us about our customers will be one of the transferred assets.

We may also disclose your Personal Data to a governmental or regulatory body, law enforcement, or other authorities, in order to enforce our terms of use for the Services, to cooperate with any direction, request or order from such parties or to report any suspected unlawful activity.

Consent

By providing your Personal Data to us, you consent to the collection, use and disclosure of your Data by us for the purposes set out in this privacy policy.

Where any Personal Data relates to a third party, you represent and warrant that the Personal Data is up-to-date, complete, and accurate and that you have obtained the third party’s prior consent for our collection, use and disclosure of their Personal Data for the Purposes. You agree that you shall promptly provide us with written evidence of such consent upon demand by us.
Each use of our services by you shall constitute a fresh agreement for us to collect, use and disclose the Personal Data in accordance with this privacy policy.

You may withdraw your consent and request us to stop using and/or disclosing your Personal Data for any or all of the Purposes by submitting your request to us in writing to Support@pricebackers.com.

Should you withdraw your consent to the collection, use or disclosure of your Personal Data, it may impact our ability to proceed with your transactions, agreements or interactions with us. Prior to you exercising your choice to withdraw your consent, we will inform you of the consequences of the withdrawal of your consent. Please note that your withdrawal of consent will not prevent us from exercising our legal rights (including any remedies) or undertaking any steps as we may be entitled to at law.

Accuracy

We endeavor to ensure that all decisions involving your Personal Data are based upon accurate and timely information. However, we rely on you to disclose all relevant information to us and to inform us of any changes in your Personal Data. As such, please disclose all relevant information necessary for us to provide services to you and ensure all information submitted to us is up-to-date, complete, and accurate. Kindly inform us promptly if there are any changes in your Personal Data.

Retention

We may retain your Personal Data for at least five (5) years, or such other longer or shorter period as may be necessary to fulfill the purpose for which it was collected, or as required or permitted by applicable laws. We will cease to retain your Personal Data or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Data was collected and is no longer necessary for legal or business purposes.

Data Intermediary

Where we process your Personal Data as a data intermediary on behalf of a third party, we will process your Personal Data in accordance with the instructions of the third party and shall use it only for the purposes agreed between you and the third party. All such Personal Data will be protected and retained in accordance with this privacy policy. We will take steps to inform the third party of any requests, complaints or questions that you may have regarding such Personal Data.

Integration of services and contents of third parties

We use within our services on the basis of our legitimate interests, content or services offered by third-party providers in order to integrate their content and services.

This always requires that the third-party providers of this content are aware of your IP address, since the content or service could not send to your browser without the IP address. The IP address is thus required for the display of this content, and we endeavor to use providers that only use your IP address for the delivery of the content or services. However, Third-party providers may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. The “pixel tags” can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer, as well as be linked to such information from other sources.

a) Google Analytics
We use Google Analytics, a service provided by Google. Google uses certain cookies for this purpose. The information generated by the cookie about your use of the services (including your IP address) will be transmitted to and stored by Google on servers in the United States. We use the stored information to evaluate your use of the website, to compile reports and to provide other services related to services use. We process the data obtained in this way on the basis of your consent. Google will not associate your IP address with any other data held by Google.

We would like to point out that this website uses Google Analytics with the extension “anonymiseIp()”. This shortens IP addresses before they are transmitted to a server in the USA. A direct personal reference in connection with the stored data is thus generally excluded. Only in exceptional cases is the full IP address transmitted to a server in the USA and shortened there.

You can object to the collection of data at any time with future effect by using the Google Analytics browser deactivation add-on at http://tools.google.com/dlpage/gaoptout?hl=en.

b) Facebook Remarketing
We use “Facebook pixels” of the social network Facebook, which is operated by Meta Platforms Inc.. With the help of the Facebook pixel, it is possible for Facebook to determine the visitors to our services as a target group for the display of advertisements, so-called “Facebook ads”. Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our services. This means that with the help of the Facebook pixel we want to ensure that our Facebook ads correspond to the potential interest of the users and do not have a harassing effect. With the help of the Facebook pixel, we can also track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our services after clicking on a Facebook ad.

You can object to the collection by the Facebook pixel and use of your data for the display of Facebook ads. To do so, you can visit the page set up by Facebook and follow the instructions there on the settings for usage-based advertising: https://www.facebook.com/settings?tab=ads or declare the objection via the US page http://www.aboutads.info/choices/ or the EU page http://www.youronlinechoices.com/. The legal basis for this processing is our legitimate interest. The use of Facebook Remarketing is based on your consent.

c) Google AdSense
We use Google AdSense, a web advertising service provided by Google. Google AdSense uses so-called “DoubleClick DART Cookies” (“Cookies”). In addition, Google AdSense also uses so-called “web beacons” (small invisible graphics) to collect information, through the use of which simple actions such as user traffic on our online offer can be recorded, collected and evaluated. The information generated by the cookie and/or web beacon (including your IP address) about your visit will be transmitted to and stored by Google on servers in the United States.

Google uses the information thus obtained to carry out an evaluation of user behavior with regard to the AdSense ads. The IP address transmitted by your browser as part of Google AdSense will not be merged with other Google data. The information collected by Google may be transferred to third parties where required to do so by law, and/or where such third parties process the information on Google’s behalf. The legal basis for this processing is Art. 6 (1) f) GDPR, our legitimate interest.

You can prevent the installation of cookies from Google AdSense in various ways:

     a) by adjusting the browser software accordingly;

     b) by deactivating Google’s interest-based ads;

     c) by deactivating the interest-based ads of the providers that are part of the self-regulatory campaign “About Ads”;

     d) by permanent deactivation through a browser plug-in.

Personal information and children

Our services are aimed at people aged 18 and over. We will not knowingly collect, use or disclose personal information from minors under the age of 18 without first obtaining consent from a legal guardian through direct offline contact.

Changes to our privacy policy

Any changes we may make to our privacy policy in the future will be posted on our Services and, where appropriate, notified to you by e-mail.
